The FCC has given Sirius XM another four weeks to come up with a plan to lease out 4 percent of its channels to qualified designated entities. That was one of the conditions the FCC put on its July 2008 approval of the merger of the two.

The FCC doesn't have much more time to decide who will get those minority channels that Sirius and XM Satellite Radio promised to lease out after they merged. And judging from the suggestions that the FCC is getting from various minority broadcasting groups, the question is still pretty wide open.

In its recently released order allowing the XM-Sirius merger, the FCC defended the union on the grounds that voluntary commitments promised by the combined company override any potential anticompetitive harm. And it says that the merger won't harm terrestrial radio.
