Judge Reduces Fine in File-Sharer Case, Could Have Wide-Ranging Repercussions for Copyright Cases

Wendy Davis
In a ruling that could put a crimp in content owners' attempts to convince downloaders to settle lawsuits, a federal judge in Boston has said it's unconstitutional to require a defendant who shared 30 tracks to pay damages of $675,000. Calling such an award "wholly out of proportion with the government's legitimate interests in compensating the plaintiffs and deterring unlawful file-sharing," U.S. District Court Judge Nancy Gertner reduced the damages to $67,500.

Ignorning RIAA Lawsuits Cheaper than Going to Trial

Nate Anderson
The same federal judge who oversaw the Joel Tenenbaum file-sharing trial earlier this year passed out default judgments against other file-swappers who never bothered to show up -- and they now owe far less than Tenenbaum.

Michael Weinberg
In an early sign from the Justice Department that President Barack Obama's appointments of content industry lawyers have intervened in a case to argue that damages for noncommercial copyright infringement of between 2,100 and 415,000 times actual damages are constitutional and reasonable.

RIAA Fights Webcasting of P2P Trial

Full article: Broadband Reports
Karl Bode
Joel Tenenbaum is a Boston University graduate student, who faces up to $1 million in penalties for uploading seven songs from a file-sharing network back in 2005. The RIAA objected to today's scheduled webcasting of the Tenenbaum case's pretrial arguments. Why? RIAA is concerned that "tech-savvy individuals" could remix or manipulate the feed to make the RIAA look bad.
