Crying Foul: Supreme Court to Hear Challenge to FCC Cussing Crackdown

Amy Schatz
Nine years after Cher used a swear word during a live awards show, the U.S. Supreme Court is finally addressing the constitutional issues behind that question. The court will consider whether the FCCn's efforts to police the U.S. airwaves for dirty words and images violate broadcasters' right to free speech and due process.

Broadcasters Take on FCC Indecency Rules in Supreme Court Showdown

Full article: Los Angeles Times
Joe Flint
The broadcast industry will try next week to persuade the Supreme Court to tell the government to back off when it comes to regulating content. On Tuesday, the high court will hear arguments from News Corp.'s Fox and Walt Disney Co.'s ABC that the FCC's rules regarding indecent programming and the way they are enforced by the agency are both vague and unconstitutional.

John Eggerton
The FCC and Justice defended the FCC's indecency enforcement policy and branded the broadcaster and creative community challenge to its enforcement regime as an "audacious attempt" to overturn Congress' judgment that kids should be protected from indecent material "on the public airwaves."

John Eggerton
Religious broadcasters have told the Supreme Court that they think indecent speech, as "reasonably" defined by the FCC, should continue to be an acceptable exception to free speech protections.

Cecilia Kang
The FCC has been fighting for years to be television's Miss Manners. Now, the Supreme Court may finally lay any question about its role to rest. The Supreme Court said it would take up a case to determine whether the FCC's enforcement of broadcast decency rules is constitutional.

Juliana Gruenwald
The Justice Departmentasked the Supreme Court to reverse a federal appeals court ruling that tossed out an indecency fine leveled by the FCC against ABC for a 2003 episode of "NYPD Blue." The Parents Television Council praised the Obama administration's decision to appeal the ruling.

FCC Complaint Filed Against Spanish TV

Michelle Garcia
A FCC complaint is being filed against a Spanish-language talk show for its use of offensive language, nudity, and attacks against LGBT people. GLAAD and the National Hispanic Media Coalition filed the complaint to the FCC in regards to the show, "Jose Luis Sin Censura." A recent analysis of the program shows blatant use of antigay slurs, verbal and physical attacks against gay people and hypersexualized images of women.

GLAAD, National Hispanic Media Coalition Urge FCC Shutdown of 'Jose Luis Sin Censura'

Joe Flint
The Gay and Lesbian Alliance Against Defamation and the National Hispanic Media Coalition want the FCC to shut down "Jose Luis Sin Censura," a raunchy talk show that might best be described as a Spanish-language version of Jerry Springer's program. The show, which airs across the country, often turns into a shouting match between young men who often insult each other with anti-gay slurs.
