Supreme Court Strikes Down Vermont Data Mining Regulation

Full article: Modern Health Care
Joe Carlson
In a victory for pharmaceutical and data-mining companies, the U.S. Supreme Court has struck down a Vermont statute that sought to outlaw the practice of pharmacies selling information to drugmakers about doctors' prescribing habits. In a 6-3 decision, the high court ruled that Vermont's law violated constitutional protections on free speech even though lawmakers drafted it with the goal of preventing pharmaceutical companies from using direct marketing to convince doctors to prescribe more-costly drugs to patients.

Steve Smith
Here is one worth noting. In the massive new report on the media economy released last week, the FCC recommends that targeted advertising may actually have positive social, cultural and political benefits.

FCC Says News Outlets Could Make Money from Online Ad Tracking

Full article: The Hill
Sara Jerome
An FCC report encourages policymakers to see the benefits in behavioral advertising to help local journalism enterprises, despite a raging debate in Washington on how to regulate online tracking to protect the personal data of consumers. Privacy experts questioned the plausibility of such methods in terms of consumer privacy and a new kind of digital divide -- one that will create a gap in who has access to quality content and who are not worth targeting.
