Risen's Gripping Affidavit

Full article: Columbia Journalism Review
Clint Hendler
James Risen, one of the New York Times's top national security reporters, filed an affidavit in a federal district court explaining why he refuses to comply with a subpoena demanding he give testimony that would identify his source (or sources) for a chapter in his 2006 book State of War. Risen’s 22-page affidavit is a stirring defense of the value of his reporting, and of the need for journalists covering national security to be able to protect the confidentiality of their sources so that they may bring matters of public interest to light.

The Free Flow of Information Act of 2009 (commonly referred to as the "Shield Law"), introduced by Reps. Rick Boucher (D-Va.) and Mike Pence (R-Ind.), would sets standards for when journalists can be compelled to disclose the identity of confidential sources. Free Press is monitoring this bill.

Congress Must Pass a Shield Law for Journalists, and Public, Now

Congress should pass and President Bush should sign a reasonable, measured shield law to push the pendulum of press liberty and government secrecy back in the direction of the First Amendment and the legitimate powers of the Fourth Estate.

Shield Law Would Protect the Public

As the Senate moves into the last week before its August recess, Majority Leader Harry Reid (D-Nev.) could do good on several fronts by moving on one of his stated priorities: Passing a measure to protect reporters' ability to keep promises of confidentiality to sources.
